Senate Bill 435 is back, need to take action

Senate Bill 435 (motorcycle emissions) has been amended and is now scheduled for a hearing on June 21st.
Bill would require stock exhaust on all bikes manufactured after January 1, 1983.


California Senate Bill 435 (Pavley, 23rd District, D) is back. Despite repeated failure to garner support for past versions, Senator Pavley continues to unfairly target motorcycle owners. The latest version of the bill would require only stock exhaust systems on all motorcycles constructed since 1983, and mandates a $300 fine for any owner who is found to be in violation.



Once again riders throughout the state are asked to contact their Senators and let them know that this is simply unacceptable. The newest version of this bill, which previously mandated smog testing, would result in thousands of currently legal motorcycles to be removed from the road, or their owners being forced to spend hundreds (or thousands) of dollars to reinstall OEM exhaust. Also, in the case of older models, many owners would be left in an all but impossible situation, as OEM exhaust systems will simply be no longer available from the manufacturer, therefore rendering the bike both illegal to ride and all but impossible to sell.


Furthermore, the lack of a labeled exhaust system does not mean a motorcycle is out of compliance with the federal law. After-market exhaust systems that comply with RSA 266:59-a are available from a number of manufacturers and often installed by their owners for a number of different reasons:
1) after-market exhaust systems are available when OEM exhaust parts are no longer, especially for older motorcycles;

2) Exhaust systems can rust out or be damaged in a minor accident, requiring replacement

3) after-market exhaust systems cost less than OEM systems, even when they are available; and

4) OEM exhausts systems are not available for custom motorcycles and kit motorcycles constructed by individuals from non-OEM components.



Lastly it is simply unfair to expect a motorcycle owner to display a ‘readily visible’ label if one is not delivered that way from the factory. Many EPA stamps are very difficult to locate on new motorcycles. Is it reasonable to expect a motorcycle owner to partially dismantle his or her motorcycle on the side of the road to prove the exhaust system is labeled?

its bad enough they break balls on this coast about baffles and decibal levels but seriously, stock exhaust on all bikes? its makes me angry and i will never even ride a bike in cali.

im glad that ct has a decent lobbing group for motorcycles and we have been able to hold off dumb shit like this and helmet laws so far.

This person is just f'ing rediculous... somebody needs to drag them into the middle of the road and then run them over, show them how many bills this stupid state has already and how much revenue they won't make off of us... I'd like to see how many Hell's Angel's are going to pay this fine, they are only hurting the average rider with this!!! Yet another law to hurt the average person, just like the stupid gun laws, does no good at all...

Truly bad news! Here in WI there already is an OEM statute for "mufflers" that applies to bikes, cars, & trucks. Trooper down the road gave me a ticket for $183!

... you will remember the introduction of emission controls on automobiles back in the 70's. For a brief period (relatively speaking) all hope was lost for high performance on street driven automobiles. Purchasing a sub 5 second stock automobile off the showroom floor was unheard of even before the 'new' rules and afterwards you were lucky to get one capable of sub 10 seconds :(. Now look where we are at today :). Technology won the day while the environment and your neighbors ears are no worse for wear.

It will happen with motorcycles, like it or not. Hell, our elected representatives are even willing to protect us from our lawnmowers :rolleyes:. With the inevitable in mind I am looking to avoid drawing attention from the long arm of the law by keeping noise levels legal. A straight through baffled exhaust of adequate length and restrained open core diameter should do the trick for me and provide a reasonable compromise :cool:. Regardless of you personal preferences you have to remember that we share this planet and would not be able to do so if it were not for the collective efforts of every one on it. Don't forget, the roads we ride on were contracted by our beloved elected officials ;).
I agree with you, but the reason this bill was declined the last time it went through the house is because the other representatives that were against this bill, said it was needless to the point that we are constantly taxing the citizens and this was another abuse of power in that area (i.e. tax after tax after tax). Read what happened, about the same time last year it got reject. I obviously paraphrased, so don't quote me on misstating the obvious.

We are supposed to be a Republic (a state in which the supreme power rests in the body of citizens entitled to vote ...) not a democracy. Our Congressmen are making all the decisions and not "we the people". They are not listening to us and are not voting the way "we the people" want them to. Hell...half the time they don't even read the Bill....that's why they give the Bills such innocuous names. We are becoming an Oligarchy nation. Wake up people.

.....and then once we vote these people out, who do suggest we vote in? Do you really think the next people are going to be any better than the former? The diseases of corruption, greed, dishonesty are well rooted in our government. Even if honest people get elected, they are soon turned to "the dark side". It's my belief that they almost have no choice if they want to "survive".

Hmmm, brb... have a dBm on my phone... curious now
83-85 dBm from 1 meter away at idle, chest level, but revving it is a completely different story. Got up to 140 dBm.

Yes, I calibrated my phone to an OSHA dBm device that has been calibrated as well.

Make sure to have the police measure the noise away from the ground and they should be 1m away as that is the international accepted way to measure dBm (the m in dBm is meter), to reduce the reverberation that the ground will add to the noise. At ground level, was about 90 dBm or so.

Just adding this all onto here to give people an idea of where we stand with the pipes atm.

No, No, No.....the young whipper snappers are also part of the problem...they don't know history, they don't know law, they don't delve into the background of the issues......:p they kept the old timers in there that voted for a major bill with nothing in it....(healthcare) ....WTH, just sign a blank check.....it's not an age thing....it's power and greed.....fact is, in just about every country out there, ours included, the government people are merely puppets (posers) who are being manipulated by a select group of individuals who are so rich and controlling that their s#!t doesn't stink and you'll never know who they are.....so powerful, yet remain anonymous......the world is theirs....not "we the people's"........
